the paper intends to analyze the features of the Italian criminal law on cigarette smuggling. The domestic system faces the illicit tobacco trade in a very peculiar way, especially if compared with the criminal law of other European countries (e.g. Germany, Greece, Portugal and Spain). The Italian strict regulation (artt. 291 bis, ter, quarter T.U.D.) could appear also unreasonable if set side by side with the domestic legislation on smuggling of goods. The paper provides a comparative analysis of the EU and the UN to the fight against smuggling. The two approaches are considerably different; and, since the one in the UN documents is more respectful of the smuggled migrants' rights, the paper suggests that a similar approach should also be embraced by the EU documents.
Human smuggling and human trafficking. A normative and criminological outline

Human smuggling and human trafficking are, from a normative point of view, strictly separated but frequently, at a criminological level, they overlap in a tangled-up situation in which it is not easy to separate them. This gap could have serious consequences in the fight against the criminal phenomena. In this brief contribution, I will try to show the extent of this gap and its consequences. Firstly, I will focus on the normative approach on HS and HT. Secondly, I will give a brief criminal outline of the two phenomena. Finally, I will try to underline the inadequacy of the dominating normative point of view.

In questo articolo mi propongo di sottoporre a vaglio critico, da prospettiva penalistica, la retorica dello smuggling umanitario, utilizzata nei mesi scorsi da una parte dell’opinione pubblica per criminalizzare l’operato delle Ong attive nel Mar Mediterraneo nel salvataggio di migranti in distress. Più in particolare, cercherò di capire se regga, da un punto di vista giuridico-penale, la qualificazione di questo operato come « favoreggiamento dell’immigrazione clandestina » rilevante ai sensi dell’art. 12 Tuimm, o se non si diano invece le condizioni per considerarlo scriminato, o comunque penalmente lecito.
